TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Investor", "you", "your") and MUSKFUND ("we", "us", "our", "Company") regarding your use of our private portfolio management platform and related services.

By creating an investor account, depositing funds, or accessing your portfolio dashboard, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Disclaimer, which are incorporated herein by reference.

We reserve the right to modify these Terms at any time. Your continued use of the platform following any modification constitutes your acceptance of the updated Terms.

MUSKFUND provides private portfolio management services, which include:

• Active management of investor capital in Indian equity and financial markets
• A secure, personalized investor dashboard for portfolio monitoring
• Regular portfolio updates and performance reporting
• Transaction logging and history tracking
• Direct communication with the portfolio manager via WhatsApp
• Announcements and market updates through the platform

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable prior notice to investors.

To use our services, you must meet the following eligibility requirements:

• Be at least 18 years of age
• Be a resident or citizen of India, or a Non-Resident Indian (NRI) legally permitted to invest in Indian markets
• Have the legal capacity to enter into binding agreements
• Not be subject to any legal restriction that would prevent you from investing
• Have been explicitly onboarded by our team — this platform is not open to the general public

We reserve the right to refuse service to anyone at our sole discretion, including declining onboarding requests without providing a reason.

When you are onboarded as an investor, you will be assigned a unique Investor ID (e.g., MFH-001) and provided with login credentials. You are responsible for:

• Maintaining the confidentiality of your password and login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Keeping your contact information accurate and up to date
• Not sharing your account credentials with any third party

We will never ask you for your password via WhatsApp, email, or any other communication channel. If you receive such a request, please report it to us immediately.

By investing with us, you acknowledge and agree to the following:

1. All investment decisions are made by our portfolio management team at their discretion
2. You understand that investment values can decrease as well as increase
3. Past performance figures shown on your dashboard are not indicative of future results
4. You are investing capital that you can afford to lose without affecting your essential financial needs
5. You have independently verified that investing with us is appropriate for your financial situation
6. You will not hold us liable for market-driven losses in your portfolio value

All deposits and withdrawals are subject to the following terms:

• Deposits must be made via bank transfer (NEFT/IMPS/UPI) to our designated account details provided via WhatsApp
• All deposits must be accompanied by a UTR number or payment confirmation shared with our team
• Minimum deposit amount is INR 25,000 for initial investment
• Withdrawal requests must be submitted via WhatsApp and will be processed within 2 to 5 working days
• We reserve the right to delay withdrawal processing during periods of high market volatility or exceptional circumstances
• All transactions are logged and reflected on your dashboard within the same business day of processing

We are not responsible for delays caused by banking system failures, national holidays, or circumstances beyond our control.

MUSKFUND operates on a fixed yearly return model. Our fee structure is as follows:

• No upfront management fees or account opening charges
• A fixed yearly return arrangement applies to gains generated on your portfolio, the specific percentage of which is communicated to you during onboarding
• No charges are levied in months where no profit is generated
• Withdrawal processing has no transaction fees from our side, though your bank may charge standard transfer fees

We reserve the right to revise our fee structure with 30 days prior written notice to active investors. Continued use of the service following the notice period constitutes acceptance of the revised fees.

Your access to the investor dashboard is provided for the sole purpose of monitoring your portfolio. You agree to use the platform only for its intended purpose and in compliance with all applicable laws.

The platform, including all content, design, code, and data structures, is the intellectual property of MUSKFUND. You may not copy, reproduce, distribute, or create derivative works from any part of our platform without explicit written permission.

We reserve the right to suspend or terminate your platform access at any time for violations of these Terms or for any other reason at our sole discretion.

You agree not to engage in any of the following activities:

• Attempting to gain unauthorized access to other investor accounts or admin systems
• Using automated tools, bots, or scripts to access the platform
• Sharing your login credentials with any third party
• Providing false or misleading information during onboarding or account management
• Using the platform for any illegal or fraudulent activity
• Attempting to reverse engineer, decompile, or tamper with the platform's code or database
• Engaging in any activity that could damage, disable, or impair the platform's functionality

Violations may result in immediate account suspension, termination, and potential legal action.

Either party may terminate the investment relationship and close the investor account with reasonable written notice via WhatsApp or email. Upon termination:

• Any outstanding portfolio value will be calculated and returned to you within 5 to 10 working days
• Your platform access will be deactivated after the final settlement
• All applicable fixed yearly return fees will be settled before the final withdrawal
• Transaction records will be retained per our data retention policy

We reserve the right to terminate any investor account immediately and without notice in cases of fraud, illegal activity, or serious violations of these Terms.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the services provided by MUSKFUND, the parties agree to first attempt to resolve the dispute through good faith negotiation via direct communication.

If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be in India and proceedings shall be conducted in English.

Nothing in this section shall prevent either party from seeking urgent injunctive or interim relief from a competent court where necessary to prevent irreparable harm.

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding relating to these Terms shall be subject to the exclusive jurisdiction of the courts of India.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
